Terms of Service

Welcome to Boletoss. By accessing or using our platform, mobile applications, or any services offered by Boletoss ("Services"), you agree to be bound by these Terms of Service ("Terms"). Please read them carefully.

Boletoss is a ticketing and event registration platform that enables organizers to create, list, and sell tickets to events, and enables consumers to discover and purchase tickets to those events. These Terms govern your use of our Services in either capacity.

If you do not agree to these Terms, do not access or use our Services.

1. Eligibility

You must be at least 18 years of age to use the Services. By using the Services, you represent and warrant that you are 18 or older and have the legal capacity to enter into a binding agreement. If you are using the Services on behalf of a business or organization, you represent that you have the authority to bind that entity to these Terms.

2. Account Registration

To access certain features of the Services, you must create a Boletoss account. You agree to:

  • Provide accurate, complete, and current information during registration
  • Maintain and promptly update your account information
  • Keep your password secure and confidential
  • Notify us immediately of any unauthorized use of your account
  • Accept responsibility for all activity that occurs under your account

Boletoss reserves the right to suspend or terminate accounts that violate these Terms, provide false information, or engage in prohibited conduct.

3. Changes to Terms

Boletoss may modify these Terms at any time. We will notify you of material changes by posting the updated Terms on our platform and updating the "Last Updated" date. Your continued use of the Services after such changes constitutes your acceptance of the new Terms.

Nature of Our Service

4. No Agency Relationship

Boletoss is a technology provider, not an event organizer. Nothing in these Terms creates a partnership, joint venture, agency, or employment relationship between Boletoss and any Organizer. All Organizers are independent third parties.

5. Platform Only

Boletoss acts solely as a marketplace. We are not responsible for the actual conduct, safety, or quality of any event listed on the platform. Attendees participate in events at their own risk, and any claims related to the event itself must be directed to the Organizer.

Organizer Terms

These additional terms apply to users who create and list events on Boletoss ("Organizers"). By creating an event, you agree to these Organizer Terms in addition to the general Terms of Service.

6. Event Listings

As an Organizer, you are solely responsible for:

  • The accuracy, legality, and completeness of all event information, including date, time, location, description, and ticket pricing
  • Obtaining all necessary permits, licenses, and approvals required by applicable law to host your event
  • Ensuring your event complies with all applicable local, state, and federal laws and regulations
  • The safety and security of attendees at your event
  • Honoring the tickets you have sold through the Boletoss platform

Boletoss acts solely as a technology platform to facilitate ticket sales and is not a co-organizer, promoter, or responsible party for any event listed on the platform.

7. Organizer Representations

By listing an event, you represent and warrant that:

  • You have the legal right and authority to sell tickets to the event
  • The event will take place as described at the time and location specified
  • All event information is truthful and not misleading
  • Your event does not violate any third-party rights, including intellectual property rights
  • You will promptly notify ticketholders of any material changes to the event

8. Boletoss Rights Regarding Events

Boletoss reserves the right to remove, suspend, or decline to list any event at its sole discretion, including events that violate these Terms, applicable law, or that Boletoss determines are inappropriate for the platform. Boletoss may also suspend an Organizer account pending investigation of any complaint or suspected violation.

9. Organizer Indemnification

As an Organizer, you agree to indemnify, defend, and hold harmless Boletoss LLC, its officers, directors, employees, agents, and successors from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to: (a) your event, including any injury, death, property damage, or other harm to attendees; (b) your violation of these Terms or any applicable law or regulation; (c) any claims by attendees or third parties related to your event; or (d) any failure to obtain required permits, licenses, or approvals.

Boletoss is a technology platform and marketplace — not a co-promoter, co-organizer, or responsible party for any event. Organizers bear full and sole responsibility for all aspects of their events.

10. Identity and Account Integrity

By registering as an Organizer, you represent that all information you provide is truthful, accurate, and complete. Submission of false, fraudulent, or misleading identity information — including but not limited to fake business names, fabricated permit numbers, or impersonation of another person or entity — is a material breach of these Terms and grounds for:

  • Immediate suspension or permanent termination of your Boletoss account
  • Forfeiture of any pending payouts
  • Civil and/or criminal legal action to the fullest extent permitted by law

Boletoss reserves the right to verify the identity of any Organizer at any time and to require additional documentation as a condition of continued access to the platform.

Payments & Fees

9. All-In Pricing

In compliance with California Business & Professions Code and the Federal TICKET Act of 2026, Boletoss utilizes All-In Pricing. The price displayed to consumers at the beginning of the transaction is the final total price, inclusive of our 7% platform service fee and any mandatory taxes. There are no hidden fees added at checkout.

10. Service Fees

Boletoss charges a platform service fee of 7% of the ticket subtotal for paid events. This fee covers the cost of technology, security, and hosting, and is non-refundable except where required by law. Free events have no Boletoss service fees.

11. Payment Processing

All payment processing is handled by Stripe, a third-party payment processor. By completing a purchase, you agree to Stripe's Terms of Service, Privacy Policy, and the Stripe Connected Account Agreement. Boletoss does not store your full payment card details. Your payment information is transmitted securely and handled in accordance with PCI-DSS standards.

12. Tax Obligations

Organizers are the Seller of Record and are solely responsible for collecting and remitting any applicable local or state taxes. Boletoss is not responsible for determining, collecting, or remitting taxes on behalf of Organizers.

Organizer Payouts & Chargebacks

13. Payout Timing

Payouts are initiated via Stripe Connect after the successful completion of an event, subject to Organizer identity verification. Boletoss is not responsible for delays in payouts caused by Stripe or by incomplete Organizer account verification. Organizers must complete all identity verification required by Stripe before receiving payouts.

14. Chargeback Responsibility

Organizers are strictly responsible for all chargebacks, disputed transactions, and associated bank fees related to their events. Boletoss reserves the right to deduct chargeback amounts and associated fees from future Organizer payouts or to invoice the Organizer directly for any resulting negative balance.

15. Pricing Accuracy

Boletoss strives to display accurate pricing at all times. In the event of a pricing error, Boletoss reserves the right to cancel orders placed at the incorrect price and issue a full refund.

Refunds & Cancellations

16. Event Cancellation — Mandatory Refunds

Per California BPC § 22507, if an event is canceled, the ticket price must be fully refunded within 30 calendar days. Boletoss will automatically trigger these refunds to the original payment method on behalf of the Organizer.

17. Postponed or Rescheduled Events

If an event is postponed or significantly rescheduled, consumers have the legal right to request a full refund within 30 days of the announcement. Boletoss encourages Organizers to promptly notify all ticketholders of any material changes.

18. Service Fee Refunds

The Boletoss 7% platform service fee is non-refundable on consumer-initiated refund requests once a transaction is completed, except where required by applicable law. In the event of an organizer-initiated cancellation, the full ticket price including the platform service fee will be refunded to the buyer within 30 calendar days.

19. Consumer Refund Requests

Refund eligibility for consumer-initiated requests is determined by the Organizer's refund policy as stated on the event listing. If you believe you are entitled to a refund not addressed by the Organizer's policy, please contact us at support@boletoss.com.

20. Force Majeure

Neither Boletoss nor the Organizer shall be liable for any failure or delay in performing their obligations where such failure or delay is caused by a Force Majeure Event, including but not limited to natural disasters, government orders, pandemics, or strikes. In such cases, the refund policies above still apply in full to ensure consumer protection.

21. Fraudulent Chargebacks

If you initiate a chargeback with your bank or card issuer for a purchase made on Boletoss, your account may be suspended pending investigation. Fraudulent chargebacks may result in permanent account termination and may be reported to relevant authorities.

Purchase Limits & Anti-Scalping

22. Quantity Limits

To ensure fair access for all attendees, a single user account may purchase a maximum of 50 tickets per paid event and 1 ticket per free event.

23. Anti-Scalping Policy

Reselling tickets purchased on Boletoss for a profit without express written authorization from the Organizer is strictly prohibited. This includes resale through third-party platforms, social media, or any other channel.

24. Enforcement

Boletoss utilizes automated systems to detect bot activity and bulk-buying. If Boletoss determines, in its sole discretion, that a user is a professional scalper or is otherwise violating purchase limits:

  • All associated tickets will be voided without refund
  • The user will be permanently banned from the Boletoss platform
  • The matter may be referred to law enforcement where applicable

Prohibited Content & Conduct

25. Prohibited Events

The following types of events may not be listed on Boletoss:

  • Events that promote or facilitate illegal activity
  • Events involving the sale of controlled substances, illegal weapons, or contraband
  • Events promoting hate speech, discrimination, or violence against any individual or group
  • Events that exploit, harm, or target minors
  • Events that are fraudulent, misleading, or do not intend to actually take place
  • Events that infringe on third-party intellectual property rights without authorization

26. Prohibited User Conduct

You agree not to:

  • Use the Services for any unlawful purpose or in violation of these Terms
  • Attempt to gain unauthorized access to any part of the Services or other users' accounts
  • Scrape, crawl, or otherwise extract data from the platform without written permission
  • Reverse engineer, decompile, or attempt to extract the source code of the Services
  • Use automated bots or scripts to purchase tickets in bulk
  • Resell tickets purchased through Boletoss for profit without Organizer authorization
  • Post false, misleading, or defamatory content on the platform
  • Interfere with or disrupt the integrity or performance of the Services
  • Impersonate any person or entity or misrepresent your affiliation

Intellectual Property

27. Boletoss Intellectual Property

The Boletoss name, logo, platform, software, and all associated content are the exclusive property of Boletoss and are protected by copyright, trademark, and other intellectual property laws. You may not use, copy, reproduce, or distribute any Boletoss intellectual property without prior written consent.

28. User Content License

By submitting content to Boletoss (including event listings, images, and descriptions), you grant Boletoss a worldwide, non-exclusive, royalty-free license to use, display, reproduce, and distribute that content for the purposes of operating and promoting the Services. You retain ownership of your content and represent that you have the rights to grant this license.

29. Copyright Infringement

If you believe content on the Boletoss platform infringes your copyright, please contact us at support@boletoss.com with a description of the work claimed to be infringed and the URL of the infringing content.

Limitation of Liability

30. Disclaimer of Warranties

THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. BOLETOSS DOES NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

31. Personal Injury & Property Damage

Because Boletoss does not own or operate event venues, we are not liable for any personal injury, illness, or property damage occurring at any event. You agree to indemnify and hold Boletoss harmless from any claims arising from an Organizer's event.

32. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, BOLETOSS AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR GOODWILL, EVEN IF BOLETOSS HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

BOLETOSS'S TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM YOUR USE OF THE SERVICES SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO BOLETOSS IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED DOLLARS ($100).

33. Indemnification

You agree to indemnify, defend, and hold harmless Boletoss and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to your use of the Services, your violation of these Terms, or your violation of any rights of a third party.

Dispute Resolution

34. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions.

35. Informal Resolution

Before filing any formal legal claim, you agree to first attempt to resolve the dispute informally by contacting Boletoss at support@boletoss.com. Boletoss will attempt to resolve the dispute within 30 days of receiving your notice.

36. Arbitration

If informal resolution fails, any dispute, claim, or controversy arising out of or relating to these Terms or your use of the Services shall be resolved by binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. YOU WAIVE YOUR RIGHT TO A JURY TRIAL AND TO PARTICIPATE IN ANY CLASS ACTION LAWSUIT OR CLASS-WIDE ARBITRATION.

Nothing in this section prevents either party from seeking injunctive or other equitable relief from a court to prevent irreparable harm pending arbitration.

37. Time Limitation on Claims

Any claim arising from your use of the Services must be brought within one (1) year of the date the claim arose, or it will be permanently barred.

Privacy Policy

This Privacy Policy describes how Boletoss collects, uses, and shares information about you when you use our Services.

38. Information We Collect

Information you provide: When you create an account or purchase tickets, we collect your name, email address, and payment information. Payment details are processed and stored securely by Stripe and are not stored on Boletoss servers.

Information collected automatically: We collect usage data, device information, IP addresses, and browser type when you interact with our Services. We may use cookies and similar tracking technologies to enhance your experience.

Information from third parties: If you sign in using Google or Apple, we receive basic profile information from those providers in accordance with their privacy policies.

39. How We Use Your Information

  • Create and manage your account
  • Process ticket purchases and issue tickets
  • Send transactional emails (purchase confirmations, event updates, refund notifications)
  • Provide customer support
  • Improve our Services and develop new features
  • Detect and prevent fraud and abuse
  • Comply with legal obligations

We do not sell your personal information to third parties. We do not display advertising on Boletoss.

40. Information Sharing

  • Event Organizers: When you purchase a ticket, the Organizer receives your name and email to manage event attendance
  • Service Providers: We share data with trusted third-party providers including Stripe for payments and Resend for email delivery, subject to confidentiality obligations
  • Legal Authorities: We may disclose your information if required by law or court order

41. California Consumer Rights (CCPA)

As a California-based user, you have the right to access, correct, or delete your personal data. In compliance with 2026 CCPA updates, we provide a "Do Not Sell or Share My Personal Information" option in your account settings. To exercise any of these rights, contact us at support@boletoss.com.

42. GDPR — International Users

Our legal basis for processing data is Contractual Necessity (to deliver your ticket) and Legitimate Interest (to prevent fraud). Users in the EEA have the right to data portability and to lodge a complaint with a supervisory authority. Contact us at support@boletoss.com to exercise your rights.

43. Data Retention

We retain transaction data for 12 months as required by California record-keeping laws for ticket sellers. You may request deletion of your account and non-required data at any time by contacting support@boletoss.com.

44. Security

Boletoss implements industry-standard security measures to protect your personal information, including encryption of data in transit and at rest. However, no method of transmission over the internet is 100% secure, and we cannot guarantee absolute security.

45. Children's Privacy

Our Services are not directed to children under 13. We do not knowingly collect personal information from children under 13. Contact us immediately at support@boletoss.com if you believe a child has provided us personal information.
